1. Data controller

2. Personal data processed

The following personal data may be processed through the site:

• Identity: first and last name.
• Contact: e-mail address and phone number (if you give it; optional).
• Customer transactions: your price quote requests (products, quantities, notes), the offers sent to you and related correspondence.
• Transaction security: IP address, browser and device information, sign-in and activity records (logs); your password is stored only in a form that cannot be reversed (a hash).
• Account: account status, e-mail verification, language preference and your account settings.

3. Purposes of processing

Your personal data is processed to:

• create, verify and manage your account;
• receive and assess your price quote requests and send you offers;
• contact you about your requests, offers and account (e-mail, phone);
• keep information secure and prevent unauthorised access and misuse;
• meet legal obligations and answer requests from authorised bodies;
• exercise and protect our legal rights in possible disputes.

4. Legal grounds

Your personal data is processed on the following legal grounds of KVKK Article 5(2):

• it is directly related to the conclusion or performance of a contract (Art. 5(2)(c)): account, quote request and offer processes;
• it is necessary for the data controller to meet a legal obligation (Art. 5(2)(ç));
• it is necessary to establish, exercise or protect a right (Art. 5(2)(e));
• it is necessary for the legitimate interests of the data controller, provided that your fundamental rights and freedoms are not harmed (Art. 5(2)(f)): information security and preventing misuse.

5. Retention

Your personal data is kept for as long as needed for the purposes of processing and for the periods required by law. After that it is erased, destroyed or anonymised.

6. Transfers of personal data

Limited to the purposes above and in line with KVKK Articles 8 and 9, your personal data may be transferred to:

• the hosting and cloud provider: Amazon Web Services (hosting the site, the database and the logs);
• the e-mail delivery provider: Resend (sending account and offer e-mails);
• public bodies and judicial authorities authorised by law (on request and as far as the law requires).

The site and its data are hosted in Amazon Web Services data centres in Germany (Frankfurt, eu-central-1), and the e-mail delivery provider is based abroad. Your personal data is therefore transferred abroad. These transfers are made in line with the conditions of KVKK Article 9.

7. How personal data is collected

Your personal data is collected electronically: through the registration, sign-in, account and quote forms on the site, through your e-mail or phone correspondence with us, and automatically while you use the site, through server logs and cookies.

8. Your rights

Under KVKK Article 11, by applying to the data controller you have the right to:

• learn whether your personal data is processed;
• request information if it has been processed;
• learn the purpose of processing and whether the data is used for that purpose;
• know the third parties in Turkey or abroad to whom your personal data is transferred;
• request correction if your personal data is incomplete or inaccurate;
• request erasure or destruction of your personal data under the conditions of KVKK Article 7;
• request that the third parties to whom your data was transferred are notified of a correction, erasure or destruction;
• object to a result against you that arises solely from automated analysis of the processed data;
• claim compensation if you suffer damage because your personal data was processed unlawfully.

You can use these rights as described in section 9.

9. How to apply

You can send requests about your rights, in line with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing to Akçaburgaz Mahallesi, 3016. Sokak No:13-19AB, 34522 Esenyurt / İstanbul, or from the e-mail address registered with us to info@birtekendustriyel.com.

Your request is answered as soon as possible and within 30 days at the latest, free of charge. If the request causes an additional cost, the fee set by the Personal Data Protection Board may be charged.
